Description

Reassignment of students to schools within the county have been approved by the administration or recommended by the Student Reassignment Appeal Board, in accordance with policies of the School Board.  They are presented for formal ratification.

GENERAL ITEMS

9. CORRECTIONS TO ATTENDANCE ZONES
Description

The latest examination of school attendance zones discovered that a 1997 redistricting inadvertently crossed State Road 72 past Myakka State Park, in effect putting the eastern-most students into attendance zones for Laurel Nokomis and Venice High Schools.  The problem is that for any such students to get to those schools, they still have to come all the way in at least to I-75 before turning south; by then, they are already close to Lakeview, Sarasota Middle, and Riverview High Schools.  At this time, there are no students who would be affected negatively by this change.  If adopted, this correction to the "walking descriptions" of the five affected schools will go into effect immediately.



Recommendation

That the School Board amend the walking descriptions to Lakeview Elementary, Laurel Nokomis, Sarasota Middle, Riverview High, and Venice High Schools effective immediately, as presented.

10. ADOPTION OF EDUCATIONAL SPECIFICATIONS
Description

School Board Policy 7.78, adopted in 2008, calls for the re-adoption of Educational Specifications at least every three years.  The Board last adopted the elementary specs in 2005 and the high school specs this past January; the middle school specs have not been adopted in the format used since 2005.  All three levels are being addressed at this time in order to update common elements on a consistent basis.  The documents represent the work of at least two dozen staff members, and the School Board reviewed the draft documents at the November 17 Work Session.  Safety & security, Small Learning Communities, and the middle school teaming model are among those issues that have been reinforced.  Significant changes include an updating to Media, clarification of all levels' playgrounds and athletic fields, and the deletion of product-specific items.  In the attached documents, changes are underlined and deleted language is struck-through.



Recommendation

That the School Board adopt the Elementary, Middle, and High School Educational Specifications as presented.

11. APPROVAL TO AUTHORIZE COUNSEL TO TAKE ALL APPROPRIATE LEGAL ACTIONS IN THE ARBITRATION CASE OF DUNCAN V. SCHOOL BOARD
Description
Employee Thomas S. Duncan grieved his initial salary placement through the step of arbitration.  The arbitrator found that the employee was a member of the instructional collective bargaining agreement but then disregarded the language of the bargaining agreement when determining the employee's placement on the salary schedule.  This violates the terms of the bargaining agreement and exceeded the arbitrator's power under the agreement and the stipulation of the parties.

Recommendation
That the School Board authorize counsel to take all appropriate legal actions, including filing suit or other application with the Circuit Court, in order to seek vacation of the arbitrator's ruling in the arbitration case of Duncan v. School Board.

AGREEMENTS/CONTRACTS

12. APPROVAL OF THE COOPERATIVE AGREEMENT BETWEEN THE SCHOOL BOARD OF SARASOTA COUNTY AND SARASOTA COUNTY GOVERNMENT FOR ALL HOSTING SERVICES SUPPORTING APPLICATIONS UTILIZED BY THE SCHOOL DISTRICT
Description

As a result of the ongoing collaboration between the Sarasota County Government and the Sarasota County School Board, the Hosting Services Agreement establishes a commitment for Information Technology Security and Support for nine key District applications and 47 servers supporting those applications.



Recommendation

That the cooperative agreement between Sarasota County Government and the School Board of Sarasota County for Hosting Services supporting our applications and servers be approved.

FIELD TRIPS

13. APPROVAL OF THE RIVERVIEW HIGH SCHOOL MUSIC-WIND ENSEMBLE FIELD TRIP TO GATLINBURG, TENNESSEE, ON APRIL 29, 2010 THROUGH MAY 2, 2010
Description
Students will be given the opportunity to meet and hear other highly rated high school bands from around the country.  Outside of the music education, our students will enjoy a rich history education by visiting the Smoky Mountain National Park on a guided tour and learn some of the history of the Appalachian Mountains and its culture.

Recommendation
That the Riverview High School Music-Wind ensemble field trip to Gatlinburg, Tennessee, on April 29, 2010 through May 2, 2010, be approved.

14. APPROVAL OF THE BOOKER HIGH SCHOOL VOCAL JAZZ ENSEMBLE FIELD TRIP TO BOSTON, MASSACHUSETTS, ON MARCH 12, 2010 THROUGH MARCH 14, 2010
Description

This is an annual competition in which 3000 students from various schools come together to participate.   The Jazz Ensemble of Booker High School are four time defending champions for Vocal Jazz Ensemble and two time defending champion Jazz Combo.  This competition allows for great exposure for Booker High School.  Students will also be participating in a tour of the Berklee College of Music and will audition for scholarships while there.



Recommendation

That the Booker High School Vocal Jazz Ensemble field trip to Boston, Massachusetts, on March 12, 2010 through March 14, 2010, be approved.



EXPULSIONS

15. APPROVAL OF EXPULSION CASE NO. 10-123
Description

The student listed in Expulsion Case No. 10-123, is in violation of an accepted Deferred Settlement Agreement for school placement.  On October 27, 2009, the student listed in Expulsion Case No. 10-123, violated School Board Policy 5.32(1)(K), Threat to Staff.  It is the recommendation of the Superintendent that the student be expelled from the Sarasota County Schools until August 24, 2010.



Recommendation
That in accordance with provisions of Sections 1006.07(1)(a)(b), Florida Statutes and School Board Policy 5.34, the holding of a hearing having been waived by the student/parent, the recommendation as specified in Expulsion Case No. 10-123, to expel the student referenced therein from the Sarasota County Schools, be approved effective immediately for the remainder of the 2009-2010 academic year, the 2010 summer session until August 24 of the 2010-2011 academic year.

Description

The student listed in Expulsion Case No. 10-126, violated School Board Policy 5.34(1)(d), Other Major Incident - Computer Violation and School Board Policy 5.34(1)(e), Disruption to Efficient Operation of the School.  It is the recommendation of the Superintendent that the student be expelled from the Sarasota County Schools until June 4, 2010.

That in accordance with provisions of Sections 1006.07(1)(a)(b), Florida Statutes and School Board Policy 5.34, and the holding of a hearing having been waived by the student/parent, the recommendation as specified in Expulsion Case 10-126, to expel the student referenced therein from the Sarasota County Schools, be approved effective immediately until June 4 of the 2009-2010 academic year.

That in accordance with provisions of Sections 1006.07(1)(a)(b), Florida Statutes and School Board Policy 5.34, the holding of a hearing having been waived by the student/parent, the recommendation as specified in Expulsion Case No. 10-038, to expel the student referenced therein from the Sarasota County Schools, be approved effective immediately for the remainder of the 2009-2010 academic year.

20. APPROVAL OF EXPULSION CASE NO. 09-308
Description

School Board Policy 5.34(4), permits the Board to hold in abeyance the expulsion of a student if the student participates in a recognized alternative-to-expulsion program.  This student has been withdrawn from the alternative program and the expulsion reinstated.



Recommendation

That the abeyance of Expulsion Case No. 09-308, be rescinded per School Board Policy 5.34(4).

21. APPROVAL OF EXPULSION CASE NO. 09-246
Description

The student listed in Expulsion Case No. 09-246 is in violation of an accepted Expulsion Settlement Agreement for alternative School placement.  On February 5, 2009, the student listed in Expulsion Case No. 09-246 violated School Board Policy 5.322 Prohibition against Use, Sale or Possession of Alcohol or Drugs.  It is the recommendation of the Superintendent that the student be expelled from the Sarasota County Schools until January 20, 2010.

 

 



Recommendation

That in accordance with provisions of Sections 1006.07(1)(a)(b), Florida Statutes and School Board Policy 5.34 the holding of a hearing having been waived by the student/parent, the recommendation as specified in Expulsion Case No. 09-246, to expel the student referenced therein from the Sarasota County Schools be approved effective immediately until January 20 of the 2009-2010 academic year.

22. APPROVAL OF EXPULSION CASE NO. 09-040
Description

School Board Policy 5.34(4) permits the Board to hold in abeyance the expulsion of a student if the student participates in a recognized alternative-to-expulsion program.  This student is being placed in a Virtual school program.

23. APPROVAL OF EXPULSION CASE NO. 10-144
Description

Approval of Expulsion Recognition from South Madison Community, School Corporation, Indiana Public Schools, Sarasota County Expulsion Case No. 10-144.  Florida Statute 230.23(6)© 2 gives the School Board as a receiving school district, the authority to honor the final order of expulsion of a student by another School Board.  School Board Policy 5.34(4) permits the School Board to hold in abeyance, the expulsion of a student if the student participates in a recognized alternative-to-expulsion program.  This student is being placed in a Virtual School/Home School program.

 

 



Recommendation

That the expulsion of the student Expulsion Corporation Case No. 10-144 from South Madison Community School, Indiana, be honored and held in abeyance per School board Policy 5.34(4) and (5).

24. APPROVAL TO AWARD BID #0529 FOR THEATRICAL STAGE INSPECTION, MAINTENANCE, AND REPAIR SERVICES
Description
Bids to provide 'Theatrical Stage Inspection, Maintenance, and Repair Services' were received from six vendors on November 12, 2009. The bid of Hile's Curtain Specialties was the best low bid meeting the advertised specifications. This bid is for a period of one year with the option to renew for two additional one-year periods. The funds for these purchases are contained in the capital budget allocated to the Facilities Services Department.

Recommendation
That the bid of Hile's Curtain Specialties, to provide 'Theatrical Stage Inspection, Maintenance, and Repair Services', in an amount not to exceed $100,000.00, be approved for award and purchase.

25. APPROVAL TO AWARD BID #0530 FOR TELEPHONE SYSTEM MAINTENANCE AND EQUIPMENT
Description
Bids to provide 'Telephone System Maintenance and Equipment' were received from six vendors on November 12, 2009. The bid of Southeastern Telecom, Inc., was the best low bid meeting the advertised specifications. This bid is for a period of one year with the option to renew for two additional one-year periods. The funds for these purchases are contained in the operating and capital budgets allocated to the Information Services Department.

Recommendation
That the bid of Southeastern Telecom, Inc., to provide 'Telephone System Maintenance and Equipment' in an amount not to exceed $500,000.00, be approved for award and purchase.

CONSTRUCTION

26. APPROVAL OF THE DELETION FOR DEMOLITION OF PORTABLE #99-648 AT ASHTON ELEMENTARY SCHOOL
Description

The Long Range Planning office has determined that this relocatable classroom is no longer needed by the district.  The specified portable recommended for deletion has been inspected by Facilities Services and Construction Services staff and is deemed to no longer be economical to maintain or renovate.  Funds for demolition are available in the capital projects account.  This portable is currently being utilized as outlined on the enclosure.



Recommendation
That the deletion of Portable #99-648 at Ashton Elementary School from the F.I.S.H. inventory for demolition be approved as presented.

27. APPROVAL OF UPDATE #2 TO THE 2009/2010 ANNUAL CERTIFICATION OF PROFESSIONALS FOR CONSTRUCTION RELATED SERVICES
Description
The recommended professionals have submitted request for annual certification by the School Board to provide professional construction related services for Sarasota County School Board projects.  These submissions are in accordance with School Board Policy #7.71.  The initial list was Board approved on 7/21/2009 (Item #64).  The newly added firms are identified, on the enclosure, at the end of the initial listing and are in bold print.  Upon Board approval, the pertinent data from these submissions will be incorporated to the existing list.

Recommendation
That Update #2 to the 2009-2010 Annual Certification of Professionals for Construction Related Services be approved as presented.

28. APPROVAL OF PAYMENT TO ARCHITECT FOR ADDITIONAL SERVICES FOR VENICE HIGH SCHOOL AND BOOKER HIGH SCHOOL MASTER PLANNING
Description
After completion of contractual obligations for master planning services for Venice High School (VHS) and Booker High School (BHS), BMK Architects, Inc. was requested by Construction Services staff to perform additional services related to these master plans.  Services included redesign of the Small Learning Community concept, redesigning the Performing Arts Theatre concept, adjusting for program changes at VHS, redesigning the Riverview High School prototype to accommodate VHS, and redesigning the BHS master plan to accommodate Orange Avenue remaining in place.  These services were not added to the contract by amendment, but were performed in good faith.  Funds for this payment are available in the capital budget account.

Recommendation
That BMK Architects, Inc. Invoice #1 dated 10/20/2009, in the amount of $32,845.00, for additional architectural services performed between 3/3/2008 and 12/4/2008 for the master planning of Venice High School and Booker High School be approved as presented.

FINANCE

30. APPROVAL OF THE SUPERINTENDENT'S FINANCIAL STATEMENTS FOR JULY, AUGUST, SEPTEMBER, AND OCTOBER 2009
Description
The Superintendent's Financial Statements, prepared on a cash basis, for the months of July, August, September, and October 2009, do not reflect any unexpected trends at this stage in the 2009-10 fiscal year.  The negative trend in the General Fund is to be expected as the District does not receive their main funding source, property tax revenues, until late November.  However, the deficit spending in the General Fund will continue as fund balance has been budgeted to decrease this fiscal year due to State revenue shortfalls and reduced property tax revenues.  The Food Service Fund has a negative unreserved fund balance due to the Food Service Fund reliance upon reimbursement from the Federal Government and payment of student meals.  With school starting later in August and a smaller summer feeding program this year, the Food Service Fund reflects a lag in receiving payment for meals.  The increase in revenues and expenditures in the Special Revenue Fund is due to the influx of Stimulus and ARRA funding.

Recommendation
That the Superintendent's Financial Statements for July, August, September, and October 2009, be approved as presented.
